Senator Shamp Advocates for Patients

and Healthcare Providers with the Passage of SB 1382


PHOENIX, ARIZONA— A major victory today for patients and healthcare providers seeking transparency, oversight and accountability of pharmacy benefit managers (PBM), after SB 1382 (pharmacy benefit managers; certificate requirements) was signed into law.


Right now, Arizona is one of just several states in the entire country that does not regulate this large sector of the healthcare industry to ensure laws are being followed. These 'health insurance middlemen' determine which medications will be covered by health insurance plans and how much those prescriptions will cost patients. If an issue arises, or a patient believes these PBMs are participating in unfair practices that are impacting their access to medications, there currently is no independent entity to turn to in order to investigate complaints. With the passage of SB 1382, PBMs will be required to apply for, obtain and maintain a valid certificate of authority to operate in Arizona. This oversight is currently required for insurance companies, utilization management companies and administrators. This legislation brings PBMs in line with the rest of the sectors of the healthcare system.


"This is a classic case of the fox guarding the henhouse, and I'm happy we're putting an end to it," said Senator Shamp. "My legislation is an important protection for patients and providers who are hitting roadblocks when problems come up, and their only options have been to turn to the insurers, who quite often own the PBMs and may not provide fair resolutions. SB 1382 will provide the necessary oversight to ensure PBMs are held accountable to state and federal laws."


This legislation will take effect beginning January 1, 2025.
