Senate Republicans Move to Strengthen Private Property Rights, Protect Arizonans from Unlawful Occupants

PHOENIX, ARIZONA—Arizona Senate Republicans are taking action to protect property owners from unlawful possession of their land and residences by advancing legislation that cracks down on forcible detainer cases. This measure aims to reinforce a fundamental principle: private property rights matter, and Arizonans shouldn't be forced to fight lengthy battles to reclaim what's lawfully theirs. This legislation passed the Senate unanimously and now moves to the House of Representatives for further consideration.
SB 1426, sponsored by Senator Wendy Rogers, clarifies Arizona's laws on forcible detainers to address cases in which unauthorized individuals occupy residential properties without permission. The bill establishes clear standards for when unlawful occupants must vacate the premises, enhances property owners' or their authorized agents' ability to reclaim possession, and ensures that courts can act swiftly. It also eliminates unnecessary procedural obstacles, allows courts to issue writs of restitution immediately in qualifying cases, and directs the Arizona Supreme Court to adopt rules that resolve these cases as efficiently as possible, without imposing any new costs on taxpayers.
"Private property rights are essential and should never be treated as mere suggestions," said Senator Rogers. "When someone unlawfully occupies another person's home or land—without consent, a lease, or any legal right—they are violating one of the most fundamental protections that Arizonans expect from the law. SB 1426 sends a clear message: property owners should not be stuck in bureaucratic limbo while unauthorized occupants exploit loopholes and delay tactics. If you break into or unlawfully occupy someone else's residential property, you do not have the right to remain there while the rightful owner navigates a complicated process. This legislation empowers courts to act swiftly, restores common sense to the process, and firmly supports homeowners, landowners, and families who abide by the rules. Arizona will continue to be a state that respects ownership, defends personal responsibility, and stands up for law-abiding citizens."
